End User License Agreement for AirCloset Rental Platform 

1. Definitions

• Platform means AirCloset, including website, mobile application, and related services.

• Owner means a registered user listing items for rent.

• Renter means a registered user renting items through the Platform.

• Item means any thing including clothing, accessory, or wearable item listed for rental.

2. Nature of Service

The Platform acts only as a digital intermediary connecting Owners and Renters. The Platform does not own, manufacture, inspect, or guarantee listed items unless expressly stated.

3. Eligibility

Users must be at least 18 years old, provide accurate registration details, and possess legal capacity to contract under Indian law.

4. Account Registration and Verification

Users may be required to provide mobile number, email address, government-issued ID, and payment details. Users are responsible for maintaining account confidentiality.

5. Listing of Items

Owners warrant that they legally own the item, the item is authentic and not counterfeit, listing descriptions and photos are accurate, and items are clean, hygienic, in good working condition and should match the descriptions mentioned on the platform before dispatch.

6. Rental Terms

Renters agree to use items only for lawful personal purposes, not modify, alter or resell items, and return items by the agreed deadline.

7. Payments and Fees

The Platform may collect rental fee, platform commission, refundable security deposit, delivery charges, and late return penalties.

8. Security Deposit and Damage Liability

Renters are liable for stains, tears, burns, permanent damage, loss, or theft. The Platform may deduct repair or replacement costs from security deposits.

9. Hygiene and Cleaning Clause

Owners must dispatch items in clean, hygienic and in good working condition. Renters must return items reasonably clean unless cleaning is separately included.

10. Delivery and Logistics

The Platform may facilitate logistics through third-party delivery partners and is not liable for delays caused by courier disruptions, force majeure, or strikes.

11. Prohibited Conduct

Users shall not commit fraud, impersonate others, manipulate ratings, list counterfeit goods, or misuse payment systems.

12. Intellectual Property

All platform content, software, branding, logos, and design remain property of AirCloset

13. Limitation of Liability

To the maximum extent permitted by Indian law, the Platform shall not be liable for garment fit issues, color differences, indirect damages, or user misconduct.

14. User Disputes

Users agree first to resolve disputes through the Platform dispute system using evidence such as photographs, timestamps, and communication records.

15. Privacy and Data Protection

User data shall be processed according to applicable Indian law and platform privacy policy.

16. Suspension and Termination

The Platform may suspend or terminate accounts for repeated complaints, fraud suspicion, policy breach, or unlawful activity.

17. Governing Law and Jurisdiction

This Agreement shall be governed by laws of India. Courts at Hyderabad, India shall have exclusive jurisdiction.

18. Arbitration

Disputes shall first be resolved by arbitration under the Arbitration and Conciliation Act, 1996. Seat of arbitration: Hyderabad Language: English.

19. Amendments

The Platform may update these Terms at any time. Continued use means acceptance.
